Picture: Getty<\/p>\n<\/div>\n<p><a href=\"https:\/\/amazingproperty.com.ng\/blog\/property-center-nigeria\/\">Real Estate<\/a> Institute of Victoria president Joseph Walton says covenants are usually put in place to create a desired \u201clook and feel\u201d in a housing estate or neighbourhood.<\/p>\n<p>\u201cCovenants are legally binding and enforceable and can apply to any property, not just those in new housing estates,\u201d Walton says.<\/p>\n<p>Details about what is and isn\u2019t allowed under a property covenant is recorded on the Certificate of Title and included in the vendor\u2019s Section 32 statement.<\/p>\n<p>Covenants cover a vast range of property characteristics, from front fences, building set-backs, building heights and even materials.<\/p>\n<p>\u201cThey can also restrict the number of dwellings and use of a property, in an effort to protect the local environment,\u201d Walton says.<\/p>\n<p>Generally speaking, covenants don\u2019t cover agreements between sellers and buyers that are personal to them.<\/p>\n<p>\u201cCovenants affect the title of a property, with the obligations of a restrictive covenant passed onto transfers of title,\u201d he says.<\/p>\n<p>\u201cCovenants last a very long time, even after the need for having them in the first place has long passed.
